Terms of Service
The ground rules for using this site, sending an inquiry and riding with us.
1. Agreement to these terms
By using this website or sending us an inquiry through it, you agree to these terms. If you do not agree with them, please do not use the site. If you are agreeing on behalf of a company, agency or organization, you confirm you have the authority to bind it.
2. Who you are dealing with
Cincinnati Pedicab is a local pedicab operation serving downtown Cincinnati, the riverfront, Over-the-Rhine, Covington and Newport. It is operated by Philip Seidenberg and is a local operating brand in the Move Mobile Media family. In these terms, “we”, “us” and “our” mean Cincinnati Pedicab; “you” means whoever is using the site or engaging us.
Where an inquiry is better handled as a regional or multi-market program, Move Mobile Media may be the party that contracts with you. We will make that clear before anything is signed.
3. What this site does
This site describes what we do and lets you start a conversation. That is the whole of it. There is no account to create, no live availability, no calendar to book against and no payment taken on this site. Prices, capacities, service areas and event details described here are indicative and can change; nothing on this site is an offer capable of acceptance.
4. An inquiry is not a booking
Sending the form does not reserve a pedicab, a driver or a date, and it does not create a contract. It starts a conversation. A booking exists only once we have confirmed the specifics — date, times, number of pedicabs, route or service area, and price — in writing, and you have confirmed back. Anything we quote is valid for the period stated in the quote.
The written confirmation for your job governs the specifics of that job. Where it conflicts with this page, the confirmation wins.
5. Riding with us
A pedicab is an open, human-powered vehicle operating in real traffic and real weather. Riding one carries risks that no operator can remove. By riding with us you accept those ordinary risks.
So that everyone gets home in one piece:
- Follow your driver’s instructions on boarding, seating and staying seated. Stay seated while the pedicab is moving, and keep hands, feet and belongings inside it.
- Do not exceed the passenger or weight capacity your driver states for that pedicab.
- Children must ride with a responsible adult, who is accountable for them throughout.
- We may decline or end a ride, without refund, where a passenger is abusive, threatening, unsafe, or too intoxicated to ride safely.
- Weather, road closures, crowd control, event overruns and police direction can all delay, reroute or stop a ride. Safety decisions are the driver’s to make.
We carry the insurance and hold the licences required to operate in the jurisdictions we serve. Specific cancellation, deposit, weather and no-show terms for your job are set out in your written confirmation: [confirm cancellation and weather policy wording].
You are responsible for your own belongings. Please do not leave anything behind; we cannot guarantee that lost property will be recovered.
6. Advertising and campaign work
Branded pedicabs, sponsored rides, sampling, ambassador programs and event activations run under a separate written agreement covering scope, creative approvals, flight dates, production, reporting and payment. These website terms do not replace it.
A few things hold regardless. You are responsible for the creative you supply and for having the rights to it, including any trademarks, images, music and talent releases, and it must be lawful and not misleading. We can decline or pull creative that is unlawful, that we reasonably consider offensive, or that would breach event or municipal rules. Route data and impression estimates we report are measured and modelled in good faith and are estimates, not audited figures. Permits and venue permissions are not guaranteed until granted, and events get cancelled for reasons outside anyone’s control.
7. Event names and affiliation
This site names Cincinnati events, venues, teams and organizations so you can tell where and when we work — a game day, a festival weekend, a convention at a particular centre. Those names, logos and trademarks belong to their owners.
Cincinnati Pedicab is an independent local pedicab operator. We are not affiliated with, endorsed by or sponsored by any of the events, teams, venues, convention centres or organizers named on this site unless we say so explicitly on the page in question. Referring to an event does not imply a permit, an official role or a partnership.
8. Our content
The text, photographs, layout, design and code of this site, along with the Cincinnati Pedicab name and logo, belong to us or to Move Mobile Media and are protected by copyright and trademark law. You may read the site, share links to it, and print pages for your own reference. You may not republish our content, copy the design, or use our name or logo as your own without written permission.
9. Acceptable use
Use the site lawfully and leave it working for everyone else. Do not attempt to break into it or into any system connected to it, scrape it at a volume that degrades it for others, submit false inquiries or other people’s details, send anything unlawful or malicious through the form, or misrepresent yourself as us.
10. No warranties
The site is provided “as is” and “as available”. We work to keep it accurate and up, but we do not warrant that it will be uninterrupted or error-free, or that every detail is current. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Nothing here limits any warranty or right that cannot be limited under applicable law, and nothing excludes our liability for death or personal injury caused by our negligence, or for fraud.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or lost business opportunity, arising out of your use of this site — even if we were told such damages were possible.
For any claim arising out of your use of this site, our total liability is limited to the greater of the amount you paid us in the six months before the claim, or one hundred US dollars. Liability arising out of a ride or a campaign is governed by the written agreement for that job, not by this limit.
12. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the site, or creative or materials you supply to us for a campaign.
13. Governing law
These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any dispute arising from them will be heard in the state or federal courts sitting in Hamilton County, Ohio, and you and we each consent to those courts. [confirm venue and whether arbitration is preferred]
If you are a consumer outside the United States, this does not remove any right you have to bring a claim in your own country of residence where local law guarantees it.
14. Changes to these terms
We may update these terms as the business changes. The version on this page is the one that applies, and the date at the top tells you when it last moved. Continuing to use the site after a change means you accept the updated terms. Changes do not alter a booking or campaign agreement already confirmed in writing.
